The tenancy agreement

Always ensure the tenancy agreement is in writing whether you are a tenant or a landlord. This will be the first place to turn in the event of a disagreement. You may wish to ask a solicitor to review the agreement for you.

SEEKING RESOLUTION

Either party in a tenancy agreement can have a complaint if they feel that the terms of the agreement are not being met. The law concerning tenancies can be complex, but the dispute can often be resolved through clear communication, so in the first instance, try to discuss the issue with the other party. If your dispute isn’t resolved, then put your concerns in writing. If this still doesn’t resolve the issue, then you can contact us for advice and guidance.

Alternative dispute resolution

If the issue isn’t resolved via discussion or after putting it in writing, then the next step is known as alternative dispute resolution. This may take the form of arbitration or mediation. In the case of arbitration, and independent person will listen to both sides and decide what needs to be done. The decision of the arbitrator is legally binding. With mediation, a mediator will help you and the landlord come to a decision. This decision is not legally binding.

Small Claims Court

If all other methods of dispute resolution fail, the final step is to enter into court proceedings. The case may go to a Small Claims Court if it is worth less than £10,000. The courts can provide a free mediation service for cases at the small claims court, and they can be conducted via telephone. If you want to evict your tenants, then you must follow correct procedures, or you may be guilty of illegally evicting or harassing your tenants.
