Experienced and understanding team

Childcare disputes and care proceedings are extremely stressful, so it’s useful to know what to expect. If you contact us, our experienced and understanding team of solicitors will be able to keep you informed.

TAKEN INTO CARE

Children’s services are a local government department responsible for the support and protection of children and young people. They will be able to provide extra help to families where they consider the children to be at risk of harm. If the social worker involved in your case is concerned about the safety of your child, they will raise their concerns. If these concerns aren’t addressed, then steps may be taken to take the child into care.

Children’s services

Children’s services will monitor your situation and the child’s environment, and will provide assistance and advice to address any concerns they have. If there is evidence that the child may have suffered harm, is suffering, or is likely to suffer harm in the future, then your child may be taken into care immediately. If this happens, then care proceedings will begin and the case will go to court.

A brief summary

A brief summary of the court process is as follows:

  1. The children’s services department and the social worker who is involved in your case start care proceedings, and you are entitled to a lawyer.

  2. CAFCASS (Children and Family Court Advisory and Support Service) will provide a qualified family court advisor (FCA) to act as the child’s guardian during proceedings.

  3. The judge will hear evidence from all the parties involved, during multiple court hearings.
